US President-elect Barack Obama said Sunday he was not ruling out possible prosecution for abuses committed under the George Bush administration, saying no one "is above the law".

(Don't get your hopes up, America. It will be unknown low level personnel in the Bush Administration who will be blamed as just some rotten apples. Just like they blamed some privates when they found torture going on in Abu Ghraib prison in Iraq.)

Your parenthetical thought was exactly what I was going to post. The real culprits will never see the inside of a jail cell.
Or like Ken Lay of ENRON, they will "die" and avoid prosecution and retire in luxury in some secret hideaway.
